Terms of Service
These Terms of Service ("Terms") govern your access to and use of bookbackhq.com (the "Site") and any services provided by Bookback ("we," "our," or "us"). By using the Site or engaging our services, you agree to these Terms.
1. Services
Bookback provides SMS-based customer reactivation services to businesses. Our standard offering is a per-booking campaign where we send personalized text messages to a customer's past client list and bill per appointment booked. Specific terms of service delivery are governed by the individual service agreement signed with each customer.
2. Pricing
Our standard published pricing is $75 per booked appointment for first-time reactivation campaigns. Other services (including ongoing retainer arrangements) are priced and described in individual service agreements. Pricing may change; current pricing is published on the Site.
3. Customer responsibilities
Customers who engage our services agree that:
- The contact lists they provide consist of individuals who have given valid prior consent to receive SMS messages from the business
- They will provide accurate business information and maintain valid opt-in records
- They are responsible for ensuring their business operations and the services we provide on their behalf comply with applicable laws
- They will respond promptly to escalations and provide information needed to fulfill the engagement
4. SMS compliance
All SMS campaigns we run include required opt-out language and comply with applicable regulations including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC requirements. We will not knowingly send messages to numbers that have not been provided to us as legitimately opted in by our customer.
5. Results not guaranteed
We do not guarantee specific numbers of bookings, conversions, or revenue outcomes from any campaign. Results vary based on factors including but not limited to list size, list freshness, the business's services and pricing, and customer response. Where we provide estimated ranges, these are illustrative only.
6. Payment terms
For per-booking engagements, invoices are issued after appointments are completed. Payment is due within 14 days of invoice. Late payments may incur a reasonable late fee. For retainer engagements, payment terms are specified in the service agreement.
7. Intellectual property
The Site and all content on it (excluding customer-provided data) is owned by Bookback or its licensors. Customer data provided to us remains the property of the customer. Workflows, prompts, and systems we develop in operating our services remain our intellectual property.
8. Limitation of liability
To the maximum extent permitted by law, Bookback's total liability for any claim arising out of or relating to our services or these Terms is limited to the amount paid by the customer to us in the three months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages. Customers are responsible for the legal compliance of the contact lists they provide.
9. Termination
Customers may terminate engagement consistent with the terms of their service agreement. We may suspend or terminate services if a customer violates these Terms, fails to pay, or provides contact data without valid consent.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Disputes will be resolved in the courts of Pennsylvania.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance.
